Existence of Border Procedure

Article 43 of the recast Asylum Procedures Directive allows for procedures relating to the admissibility and/or the substance of an asylum application to take place at the border for up to a period of four weeks. Where this time elapses and no decision has been taken the applicant will be granted access to the territory, although a derogation seems to be possible for an indefinite period of time where there are a large number of third country national arrivals.
